TERMS & CONDITIONS

The following are the Terms & Conditions applicable to all sales of goods by Bowes & Co. Wines Limited (hereinafter "Bowes Wines").

These Terms & Conditions shall form part of all contracts for the supply of goods by Bowes Wines to any buyer (hereinafter "The Buyer") and prevail over any inconsistent terms or conditions contained in or referred to in the Buyer's order or correspondence or elsewhere. The purported purchasing on any other terms and conditions shall not be deemed to form part of the terms of sale.

Waiver of any breach of any term of these conditions shall not be deemed to be a waiver of any succeeding breach.

APPLICATION

Purchases can only be made by persons aged 18 or over. The contract will cease to exist and we will not fulfill your order if you are under 18 years of age at the time you submit your order.

When submitting an order you will be accepting these Terms & Conditions in full.

We reserve the right not to accept your order, in which case we will not have any further obligation to you.

We may accept the whole or part of your order, both in respect of the kinds of products ordered and the quantity of products ordered. The price will be reduced accordingly.

DELIVERY

Delivery is only available throughout the Republic of Ireland, although we can accept orders from overseas customers for delivery in Ireland.

Unless otherwise specifically agreed in writing, delivery shall be affected when the goods are delivered to the Buyer's premises or to its agent or collected by the Buyer or delivered to a carrier paid by the Buyer, whichever shall first occur.

Where practicable, we aim to deliver your wine within two working days of receipt of your order in Dublin and six working days for Rest of Ireland. This may be extended, particularly so during peak periods such as Christmas. Deliveries are made during week-days and not during Public Holidays or weekends.

All delivery dates are approximate only and not of contractual effect.

We accept no responsibility for late or non-delivery of goods arising from incorrect delivery information being provided (including typographical errors).

We will not dispatch the products until we have received cleared funds.

Bowes Wines reserves the right to make partial deliveries if necessary.

Upon the occurrence of any cause of whatsoever nature beyond the control of Bowes Wines or force majeure, Bowes Wines shall not be liable for any delay in delivery, non-delivery, destruction or deterioration of all or any part of the goods or for any other default in the performance of this contract arising from and/or Bowes Wines may, by written notice, cancel any contract either wholly or partially or if the making or transfer of any payment by the Buyer to Bowes Wines is impossible or is likely to become impossible or is delayed or is likely to be delayed by more than 30 days Bowes Wines shall have the option either to cancel this contract either wholly or partially or to extend the time for delivery during such period as said circumstances or any of them shall continue. In the event of such cancellation by Bowes Wines or any such postponement, the Buyer shall have no claim against Bowes Wines.

CANCELLATIONS

We guarantee the quality of our wines and service. However, if you are not completely satisfied by your experience, please inform us and we will do our best to resolve your problem.

Any cancellations in respect of any order must be notified in writing to Bowes Wines within two days of placing the order.

Your statutory rights will not be affected.

CLAIMS

The Buyer shall notify Bowes Wines of any errors and shortages concerning the goods in writing within 7 days of delivery to the Buyer.

Goods should be examined on arrival and any loss, defect or breakage must be reported to Bowes Wines in writing within 7 days of delivery. Defective goods MUST be held for inspection. Claims cannot be otherwise entertained.

Bowes Wine's liability to the Buyer in respect of any goods supplied to the Buyer and proved to be defective shall be limited to the purchase price of such goods (including any delivery charges) paid for under the contract. Bowes Wines shall have no liability to the Buyer in respect of any loss of profit or any consequential or indirect loss or damage of any kind to the Buyer howsoever caused.

PRICES

All prices are strictly in accordance with Bowes Wines current price list unless otherwise quoted. The price to be paid for the goods sold by Bowes Wines shall be Bowes Wine's price ruling at the time when the goods are dispatched by Bowes Wines.

All prices include applicable Irish Excise Duty and VAT at 21%. We may have to charge more than the amount stated to reflect an increase in the cost of the products for reasons beyond our reasonable control - for example, because of an increase in duty or taxation. You will be notified of any such increase beforehand, which shall be fair and proportionate.

PAYMENT

Payment is due before delivery, by either credit card or cheque.

The property in all and any goods supplied by Bowes Wines shall remain in Bowes Wines, until Bowes Wines has received payment in full for all sums due and owing on any account or contract by the Buyer. In the event of non-payment by the buyer by the due date, Bowes Wines shall be entitled in addition to all other rights to enter any premises where the goods may be stored and recover possession of the goods. The goods shall be at the entire risk of the Buyer from the time the goods are delivered.

No order or contract for goods is transferable by the Buyer without Bowes Wine's written consent.

DATA PROTECTION

Property Rights
You acknowledge that the content of the website is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.

Website Conduct
You agree to adhere to all applicable local, state, national and international laws and regulations. You hold sole responsibility for all acts or omissions that occur while using the website, including the content of your transmissions through the website. All information, designs, drawings and other specifications provided on the website remain the exclusive property of Bowes & Co. Wines Limited. Any use including copying, reproduction, duplication, transmission, or display of the content of this website, without the express permission of Bowes Wines for purposes other than the viewing of information or for ordering purposes, is strictly prohibited.

PRIVACY POLICY

By registering your details on our website, you consent to Bowes Wines recording, holding and using personal data we collect about you. All personal details entered on Bowes Wines are kept strictly confidential and are not shared with any other party. They are stored on a secure Internet server for only as long as you wish them to be there.

We collect personal information when you make a purchase from this website. The type of information we collect includes: your name, address, phone number(s), e-mail address, special delivery instructions and time of delivery

We may use this to: contact you about the status of your order, process and dispatch your order or gift to a specified delivery address, occasionally email you with details of our products, special promotions or site enhancements. If you would prefer not to receive these mailings, please send us an email to info@boweswines.com, with 'Unsubscribe' in the subject line.

MODIFICATION OF TERMS

We reserve the right to alter the terms of use or conditions regarding the use of the website (particularly including those relating to price and availability) at any time. We will notify you by posting an updated version of the Terms & Conditions on the website.

TERMINATION

We may terminate the website with or without cause at any time and with immediate effect. In addition, we, in our sole discretion, may terminate your account for violation of the letter or spirit of these Terms & Conditions.
